Article 1: Application of the terms and conditions

The present terms and conditions apply to all sales completed on the "silhouette-by-s.com" website which is Silhouette by S Company's property. At any time, the silhouette-by-s.com website reserves the potential to adapt or modify the terms and conditions without prior notice to customers. When placing the order, customers acknowledge that they have read the particular terms and conditions stated on this screen and expressly declare they accept them without reservation.

Article 2: Order confirmation

The contractual information will be confirmed by e-mail. Some orders must be double-checked by our audit department. In this case, you will be informed by e-mail of the supporting documents you must send in order to obtain final validation of your order.
Silhouette by S reserves the right to cancel any order in case of non-receipt of these documents or on receipt of documents deemed non-compliant. Customers must verify the completeness and accuracy of the information that they provide to silhouette-by-s.com. The latter cannot be held responsible for any entry errors (price, product description).

Article 3: Information about products

  • On its website, Silhouette by S presents the products to be sold with the necessary features which make them compliant with Article L 111-1 of the Consumer Code. This allows the potential customer to be informed of the essential features of the product they wish to buy before their final order.
  • The offers displayed on the website silhouette-by-s.com are only valid within the limit of available stock. .
  • Total or partial inability to use any products, particularly due to incompatibility of materials cannot give rise to any compensation or refund or calling silhouette-by-s.com's liability into question. The customer remains the sole judge of the amount of products ordered with those already in his possession.
  • Hypertext links may refer to other websites; however, silhouette-by-s.com denies any responsibility in the event that the content of these sites contravene the legal and regulatory provisions in force.

Article 4: Prices

Prices are quoted in Euros and are applicable only to the date on which the customer sends the order confirmation. They do not take into account the delivery costs - invoiced additionally - and indicated before the final confirmation of the order. The prices take into account the VAT, which is applicable on the day of the order. Any change to the legal VAT rate will be automatically reflected in the price of the products displayed on the website on the exact date stipulated by the implementing decree. Unless a specific offer is indicated on the website, the entire payment must be made at the time of the order.The sums paid can never be considered as deposits or down payments.

Article 5: Payment method

The customer has the advantage of a secure means of payment via the Paypal service and CIC Monetico to pay for the order.
The silhouette-by-s.com website reserves the right to suspend the processing of an order and delivery in case of refusal of authorisation of payment by credit card on behalf of the officially accredited bodies or in case of non-payment.
In particular, silhouette-by-s.com reserves the right to refuse to make a delivery or to honour an order from a customer who has not fully or partially settled a previous order or with whom a dispute relative to payment is ongoing.
When necessary, silhouette-by-s.com can set up an order verification procedure to ensure that no-one uses the bank details of another person without his/her knowledge. As part of this verification, the customer will be asked to fax a copy of an identity document and a proof of address to Silhouette by S. The order will be validated only upon receipt of the documents sent and verification by our services.

Article 6: Availability of products

The order will be executed no later than 30 days from the day following the customer's order once the latter has been definitively validated (payment received and order verification procedure carried out). In the case of unavailability of the product ordered, usually from our suppliers, the customer will be informed as soon as possible and will be able to cancel his/her order.
The customer will then have the choice of asking for a refund, of the sums paid, if any payment has been made,  within 30 days at the latest of the payment.

Article 7: Terms and delivery times

The products are delivered to the address indicated by the customer on the order form in metropolitan France and abroad. The customer must verify the completeness and the accuracy of the information that is provided to silhouette-by-s.com.

The latter cannot be held responsible for any order entry errors and the resulting consequences in terms of delay or delivery errors. In such a case, all expenses incurred for the reshipment of the order will be entirely the responsibility of the customer.
Silhouette by S cannot be held responsible for delivery delays due to errors or disruptions caused by transport (in particular, total or partial strike of the postal services, means of transport and/or communications). The customer is required to check the condition of the  packaging of the goods on delivery and to report damages caused by the carrier on the delivery note and to silhouette-by-s.com within 3 working days.

The standard delivery time is 8 to 15 days. If the purchase is made using a voucher, the delivery time can exceed 15 days, regardless of the delivery method chosen.

Article 8: Information on prices, shipping costs and general delivery information

To minimise transport costs, all products of small or medium size are shipped by a postal service: Colissimo Suivi. As well as being economical, this service delivers in 48 hours throughout France and offers you the possibility of collecting the products ordered from your local post office if you should be absent from the original place of delivery when the postman arrives.
For example, if you are absent on the delivery day, your postman will leave a notice in your mailbox, which will enable you to collect your parcel from your local Post Office during business hours and within 10 days. Colissimo Suivi is a very reliable service. However, as with any shipment, there may be a delay in the delivery or the product may be lost.
In the case of late delivery in relation to the date we have indicated in the shipping email, we ask you to notify us by telephoning or emailing us. We will then contact the Post Office to start an investigation. A Post inquiry may take up to 21 days from the initial date of the investigation. If the product is found within this timeframe, it will be returned immediately to your home (in the majority of cases). If, however, the product is not found at the end of the 21-day investigation period, Swiss Post considers the package to be lost. Only then can we send you a replacement product at our expense. If the product(s) ordered are no longer available at that time, we would refund the amount for the products concerned. If the product(s) are still available, but the sale price on the website was different, we would apply the new sale price, either by reimbursing the difference or by paying the price difference ourselves.
We decline any responsibility for the elongation of delivery periods due to the carrier, particularly in the case of product loss or strikes.

Shipping costs and taxes are estimated and updated during the buying process. They are based on your billing and shipping address.

Our delivery times may vary. For Metropolitan France, it takes between 3 and 5 days from the time you receive an email indicating the dispatch date. For Switzerland and Belgium, please allow 7 to 10 days without counting customs clearance. For DOM-TOM and international, please allow up to 1 month. The email regarding shipping includes your tracking number, Colissimo for Metropolitan France, and DHL for international deliveries, including DOM-TOM. In this email, you will also find the Internet link that allows you to track your package. If you do not receive an email regarding the shipping of your product after 10 working days, please contact us with your order number.

Article 9: Product guarantee

In accordance with Article L. 211-4 of the Consumer Code, the Silhouette by S Company is required to deliver products, which are in conformity with the sales contract. The company is liable for any lack of conformity resulting from packaging, installation information or occurring during installation when it is under the company's responsibility according to the contract.

Article 10: Right of withdrawal

In accordance with the provisions of Article L.121-21 of the Consumer Code, customers have 14 days to claim their right of withdrawal without having to give any reasons. The withdrawal period starts on the day of receipt of the order by the customer or by any third party designated by him/her. If the 14 day period ends on a Saturday, Sunday, or a holiday or non-working day, it is extended to the next business day.

In any case, the customer must return the article(s) subject to the right of withdrawal to Silhouette by S, without undue delay and at the latest within 14 days of the communication of his/her decision to withdraw.
The customer must attach a form or separate sheet of paper indicating the number of the order to the parcel.
When the right of withdrawal is implemented, Silhouette by S will reimburse the customer for the price of the item(s) concerned. The refund will take place within 14 days from the date the customer informs Silhouette by S of his/her decision to withdraw.
In any case, this refund cannot occur before Silhouette by S receives the item(s) subject to the customer's retraction or before receiving a proof of return of the product.
The refund will be made according to the means of payment of the returned order, unless the customer agrees otherwise with Silhouette by S.

A refund cannot be made if the article has been opened or used. The goods must be returned to us in their original packaging and in perfect condition, allowing them to be resold.

Article 11: Applicable law

The present terms and general conditions are subject to French law. This is the case for both fund rules and form rules. In the case of litigation or complaint, the customer should first contact the silhouette-by-s.com website to try and obtain an amicable solution.

Article 13: The basket

  • The basket:
    By clicking on "Add to basket" you can choose the products you wish to order and your products will be placed directly in the shopping basket. You can modify your selection at any time until the dispatch of your order, by changing the quantity or removing the selection by clicking the "Remove" button. Clicking on "Checkout" will take you to the next step.
  • Cash register:
    If you already have a customer account, log in with your e-mail address and password. You also have the opportunity to register as a new customer. Your details will be recorded, processed and used in accordance with data protection (confidentiality agreement). Once registered, you can choose your delivery method. Then click "Next" to go to the next step.

    Any other use or transmission of your personal data to third parties is excluded.

  • Check billing address/Choose payment method:
    Now choose the payment method you prefer and do not forget to check your billing address. Click "Next" to confirme and move on to the next step.
  • Check the shipping address/Choose the shipping method:
    Check your shipping address and select the shipping method you would like to use. Clicking on "Next" will take you to the next step.
  • Complete the order procedure and right of cancellation:
    You will receive an overview of your order: shipping address, selected products, billing, and your contact details. Please check the accuracy of all the data and read the General Terms and Conditions. You can only finalise your order when you accept the General Terms and Conditions. Silhouette by S reserves the right and the conditions of application of the promotional offers offered. These are subject to conditions (use restrictions, minimum purchase, limited period or other) and are neither negotiable nor debatable.
